A Kohima court sentenced a woman to seven years’ rigorous imprisonment for causing the death of her newborn in a 2022 case at Oking Hospital.

DIMAPUR — The Court of the Principal District and Sessions Judge, Kohima has sentenced a 28-year-old woman to seven years of rigorous imprisonment for causing the death of her newborn.
A press release issued by the district’s public prosecutor on Thursday informed that the court convicted the accused Roshni Basnet under Section 304 Part II of the Indian Penal Code during a verdict pronounced on March 23. The sentencing was delivered on March 25.
The case dates back to May 22, 2022, when the accused delivered a baby in the bathroom of Oking Hospital in Kohima and allegedly threw the newborn from a second-floor window.

The infant was later found in a drainage but succumbed to injuries despite medical intervention.
During the trial, the prosecution examined 11 witnesses.
The court sentenced the accused to seven years of rigorous imprisonment and imposed a fine of INR 5,000. In default of payment, she will undergo an additional six months of simple imprisonment.
While delivering the judgment, the court observed that the offence led to the death of a completely helpless newborn and reflected a grave disregard for life.
At the same time, it stated that the act appeared to have been committed under distress and that the accused was a first-time offender. However, it held that the seriousness of the offence warranted conviction and punishment.
