With due respect, first of all I salute all the traffic personnel for all the commendable work carrying out by your benign department.
But Sir, it so happened that on the night of 19th April 2018 around 7 PM, Near Purana Bazar gas station, some armed police personnel in khaki dress under the command of one Lance Naike were stopping all two and three wheelers and were collecting Rs. 100 as penalty to those without Helmet and proper licenses, i.e. without any challan or e-challan.( some were allowed to go although without helmet and proper licenses)
So, as an offender I paid Rs.100 without protesting. (Who will dare to protest the armed police?)
So, Respected Sir, kindly educates the general public (defaulters) these five points mentioned below:
1. Is it legal for any police personnel to collect penalty i.e also without challan or e-challan. (Refer: the Indian Motor Vehicles Act, Sec 132)
2. When did the Dimapur Traffic Police authorised the armed personnel to collect fine? Was it published in the newspaper for general awareness?
3. Did the same amount collected by those armed personnel on different occasion in different areas, deposited or handed over to the concerned department (Traffic)?
4. If they are authorised then kindly let us know under which law and section?
5. Why only two and three wheelers? Sir, this letter is not to tarnish the name of any department but to spread awareness only, and to stop illegal things going on in the society by misusing the power given by the Govt. without the notice of your concerned department (Traffic).
My point here as a concerned citizen although an offender is that collect the fine in a legal way by the legal department (Traffic) and not by other elements who are not authorised for the same job.
Your prompt action in this regard will be highly appreciated.
