Kohima, Nov. 1 (EMN): While stating that the State Governor, PB Acharya, has murdered the Constitution of India and violated all the democratic practices, the NPF Youth Wing has beseeched upon the President of India to immediately intervene and recall the Governor and also to take cognizance of the biased actions of the Speaker of the Nagaland Legislative Assembly.
In submitting a seven-point memorandum to the President of India, the NPF Youth Wing pointed out that the Governor, without any rhyme, has dismissed the Shürhozelie-led DAN government on the July 19, 2017, at around 12 noon.
Informing the President about the events that followed, the memorandum signed by NPF Youth Wing president, N Vihoshe Swu, and the working president, Bendangtoshi, said TR Zeliang was invited to form government that day itself with barely three hours of dismissal of the NPF-led DAN government.
“It is indeed surprising that TR Zeliang was sworn-in as the chief minister of Nagaland at 3 PM,” the memorandum said adding that “TR Zeliang was also sworn-in without a letter of support from the NPF party.”
Further stating that that TR Zeliang was expelled from the NPF on July 19, the NPF Youth Wing presented before the President of India that the Governor should not have invited TR Zeliang to form the government.
Further stating that the Governor summoned the assembly for the floor test on July 21, the youth wing informed that the NPF accordingly issued whip through its chief whip Keyanilie Peseyie to vote against the motion moved by TR Zeliang, citing reason that he (Zeliang) had been expelled from the party w.e.f. July 19, 2017.
“That, in total defiance of the party whip issued by the party, altogether 36 NPF MLAs including the speaker voted in favour of TR Zeliang. As a matter of fact, the NPF party has moved disqualification petition in the Speaker’s court against the 36 MLAs who had wilfully defied the party Whip on July 21, 2017,”the memorandum further stated.
Even after a lapse of three months, the youth wing body said the Speaker of the NLA has not taken any action till date. On the other hand, it claimed that instead of taking action as per the laid down provisions under the constitution of India, the Speaker is justifying in making flimsy excuses which is amounting to subjugating the rule of law.
Informing the President that the NPF Youth Wing has resorted to a peaceful dharna in the form of sit-in protest in front of the Nagaland Civil Secretariat beginning from October 23, the party’s youth wing justified it stance that this (dharna) was done to register their protest against the inordinate delay on the part of the Speaker in taking action on the disqualification petition against the 36 NPF MLAs, and further for not taking necessary action on the various other issues such which includes - appointment of Yitachu as the Chief Whip of the NPF party in place of late Keyaneilie Peseyie, and also on recognition of Küzholüzo Azo Nienu as the leader of Legislature Party, which it said are mandatory under the prevailing Parliamentary practices.
“It is indeed surprising, that the “Honourable Speaker”, instead of taking up the case for disqualification of the 36 MLAs, have resorted to summoning the nine MLAs for disqualification which is totally wrong in the eyes of the law,” the party’s youth wing said.
“All these events were carried out in total violation of the Indian Constitution. The Constitution of India has not been made applicable to the politically sensitive State of Nagaland. The Government of India and the Naga Nationalist Groups are in a political dialogue to bring an amicable solution to the Seven (7) decades old political issue. The NPF party, a registered political party with the Election Commission of India has been pro-active in bringing permanent peace and permanent solution,” it further stated.
The memo submitted to the President of India which demanded for recalling the Governor, also stated that “in the event of anymore disrespect to the Constitution of India and its legal system, the Governor Acharya, who is the constitutional head of the State, will be held solely responsible, and not the Nagas.”
