KOHIMA, JULY 14 : The criminal complaint case against member of Lok Sabha for Nagaland, Neiphiu Rio, in regard to his educational qualification ‘has been stayed by the District & Session Judge until the transfer is disposed off’.
On Thursday, the court stayed the proceedings of the case with the District & Session Judge, because the respondent on behalf of Rio had filed for transfer of the case to a neutral court.
Talking to Eastern Mirror, Rio’s counsel said his client (Rio) opted for transferring the case to a neutral court. The counsel supported the transfer basing on the ground that the matter should be tried in ‘all fairness’. He went on to say that the case is politically motivated and that justice cannot be delivered at the court of the Chief Judicial Magistrate, with reasons best known to all.
Responding to the case filed by the respondent party for transfer of case to another court, the complainant Dr. Rosemary Dzüvichü and her counsel asked for three week’s time to reply the respondent party. The date has been scheduled on August 12, 2016.
Rosemary’s counsel told Eastern Mirror that they have moved for ‘filing of power appearance (Vakalatnama). The main case has not been admitted, he further informed.
The case on Rio’s educational qualification began when the complainant Dr. Rosemary Dzüvichü filed a case against him in the court of the Chief Judicial Magistrate.
The respondent Neiphiu Rio was represented by Advocate Ashipri Zho as the counsel, while Advocate Joshua Sheqi, along with senior advocates A Zhimomi and Imtilongem were the counsels on behalf of the complainant party.
