Everybody Dr. Shürhozelie is yet to be mandated by the people at the grassroots level through a bye-election on 29th July 2017. But he was mandated by mandated MLAs to be the Chief Minister for 6 Months which is provisionally legal under the Constitution of India and the MLAs cannot say that he is not mandated. Rather, he was mandated by them to save the situation at a difficult time both for the party and government.
T.R. Zeliang is a mandated MLA from Peren. But his leadership as CM was rejected by mass-based Civil societies’ movement during Jan-Feb. 2017 for not paying heed to the mass-based popular opinion and betraying the church agreements, and therefore Zeliang has no moral right to reclaim CM post till he secures a fresh mandate from people. The MLAs are also yet to be mandated whether they can cross floor every now and then or, to camp at Kaziranga or elsewhere, to bring another government.
The simple reason for the people is that, the people of Nagaland have mandated NPF to rule. While NPF is still ruling, the NPF Ministers/MLAs acting against NPF Government is nothing short of anti-party activity and a hijacking of people’s wish and mandate and for which Party President has every right to act against any kind of antiparty activities if he cares. As such, all suspension orders issued are valid provided these are issued in coordination with Disciplinary Action Committee of the party or whatever committee set up to deal with anti-party activities of the party members.
The threats to Bureaucrats/HoDs/AHoDs by 8 MLAs of TR Group is not valid as they are now outside the periphery of the Ministry.
As for the incumbent CM, he is in the chair mandated by mandated members (MLAs) for six months. There is nothing wrong to obey his direction by the bureaucrats at this juncture till 21st August 2017 or till such time a new government take-over the crown, whichever is earlier. MLAs are not mandated to destabilize the government every now and then at their own whims but to form Government for deliverance of goods and render yeoman services to the citizens and also to give a sense of security to people.
