Kohima, July 17 (EMN): The Kohima Bench of Gauhati High Court on Monday reserved its judgment on Governor PB Acharya’s directive asking Chief Minister Dr. Shürhozelie Liezietsu to seek a floor test. The High Court on July 14 issued the stay on a writ petition filed by Liezietsu till today.
Normally, the court hearings last till 4 pm, however, today’s hearing on the said case was said to have lasted till 6 pm. Senior legal professionals who were present at the hearing said both sides have put up very good arguments and they were unsure of which side the verdict will swing.
It was also learnt that the court allowed a prayer to file additional affidavit on behalf of Liezietsu by senior counsel Meenakshi Arora with the condition that the affidavits be filed today to be heard on Tuesday. However, opposition counsels were said to have raised objections and the matter continued to be heard till 6 pm.
The delivery of judgement and order for the case is reserved till Tuesday and listed for 2 pm.
TR Zeliang confident of floor test
Dimapur July 17 (EMN): Former Chief Minister TR Zeliang, who has the support of 43 MLAs including some NPF and independent legislators, said he will move for floor test since he has the support of the majority.
It may be recalled that the Governor of Nagaland PB Acharya has asked the chief minister Dr Shürhozelie Liezietsu to go for floor test on or before July 15, however, he refused and had gone to the court.
Talking to media persons today at the Assembly Secretariat after casting his vote for the Presidential election, Zeliang said his party will wait for the court’s decision and then decide its move. It may be mentioned that the court gave the stay order till July 17.
The former chief minister stated that they will move for higher court, if in case the court gave its verdict in favour of the sitting CM. He, however, said that he was doubtful that the court will give its verdict in favour of the CM.
“We are in majority democratically and even legally,” Zeliang said maintaining that there is difference between party affairs and business of the legislature.
“After we form the government, we will talk about reconciliation,” he said adding that party affairs should not get involved in the affairs of the legislature.
On the by-election where Shürhozelie is also a candidate, he stated that it will not have any effect on their position.
“Dr Shürhozelie losing or winning the by-election will not have any effect on our group, because we are in complete majority,” he said.
