Dimapur, Aug. 4 (EMN): The Kohima Bench of the Gauhati High Court on Aug. 3 dismissed the writ petition filed by the Public Service Aspirants of Nagaland (PSAN) and the Against Corruption and Unabated Taxation (ACAUT) against 706 backdoor appointments.
The court, in its judgment, observed that the petitioners (PASN and ACAUT) will have to show that they are aggrieved by the appointments made and ruled that they have ‘to give material particulars to challenge the appointments made, keeping in mind the relevant recruitment rules’.
The court ruled that the petition is “not maintainable in its present form.” However, the petitioners - ACAUT and ACAUT and Nitoka V Swu (of PSAN) - have been given the liberty to make a fresh challenge to the appointments of the impleaded respondents and other persons as per law, as the present writ petition has not been dismissed on merit, but only on the issue of maintainability.
Justice Michael Zothankhuma ruled that the petitioners would have to show that they were aggrieved by the appointments and provide material particulars to challenge the appointments.
He ruled that the petitioners had made a sweeping challenge to appointments made in various grades across 25 departments and sought to brush them aside at one go, the judge said it was very difficult to sift through the facts of the in the absence of complete material facts.
