Dimapur resident approaches Gauhati High Court alleging multi-storey building encroachment on his GS Road property, seeks legal relief.

DIMAPUR — A Dimapur resident has moved the Kohima Bench of Gauhati High Court alleging that a multi-storey building constructed by a local trust encroached on his property and sought legal intervention to stop the construction.
Suresh Jain Sethi, owner of a building on GS Road, filed a writ petition against the deputy commissioner of Dimapur, Dimapur Municipal Council (DMC), and the Digamber Jain Samaj, represented by its president, Anil Sethi.
According to the petition, the Digamber Jain Samaj obtained a No Objection Certificate (NOC) on May 18, 2019, to construct a multi-storey RCC building on an adjoining plot east of Sethi’s property.

The NOC required a 5-foot margin on the western side, bordering Sethi’s land. The petitioner alleged that the margin was not maintained and that part of the new building encroached onto his plot.
Sethi further claimed that despite submitting representations to DMC seeking action, the authorities had not intervened to stop the alleged illegal construction.
In an order passed on September 25, Justice Manish Choudhury issued notice to the respondents, returnable on October 17.
The court kept the petitioner’s request for interim relief, seeking to halt ongoing construction, open for consideration on the returnable date.
