Dimapur, Feb. 16 (EMN): In view of the upcoming 13th General Assembly Election to the state of Nagaland, the district election officer of Mokokchung, Sachin Jaiswal has informed village councils / organisations / groups in Mokokchung district which restricts free movement of citizens and any contesting candidates in their respective village is against the Article 21 of the Constitution of India and against the pronouncement of Gauhati High Court (Kohima bench) on Feb. 14.
For the stated reason, DEO has cautioned village councils / organisations / groups who are indulging in such unconstitutional activities not to issue such diktats.
Village council or group indulging in such activities will be recommended for dissolution under Village Council Act.1978 if they do not abide to the order of the Government in this regard, the order stated.
Also, DEO has informed all section of people in the district that offences and corrupt practices such as creating, promoting, circulating rumour in an attempt to promote enmity, hatred between different classes of the citizens of India on the ground of religion, race, caste, community or language by any individual or group will be punishable with imprisonment which may extend to three to five years or with fine or both under relevant section of the Representation of the People Act.
Any person or group found indulging in the mentioned offences, FIR under relevant section would be filed against them, it informed.
High Court directs govt. to ensure entry of candidates
A judgment and order from the Gauhati High Court, Kohima Bench on Feb. 14 has directed the Nagaland Government to ensure that candidates contesting in the Nagaland State Legislative Assembly election 2018 be allowed to enter their native village without any obstruction.
Giving the verdict in the case of the complaint filed by Mayang Lima, a candidate contesting from the Arkalong assembly constituency and James Imtikumba Yaden contesting from 21st Tuli assembly constituency, both of Nationalist Democratic Progressive Party (NDPP) under Mokokchung district, the Kohima Bench of Gauhati High Court, in its judgment directed the state government to ensure that the petitioner is allowed to enter their village. The court ruled that the candidates should be allowed to participate in the elections as per law.
