Dimapur, July 29 (EMN): The ACAUT Nagaland along with Public Service Aspirants Nagaland (PSAN) has filed a public interest litigation (PIL) against what it has alleged as 705 backdoor appointments made by 35 different departments of the government of Nagaland.Dimapur, July 29 (EMN): The ACAUT Nagaland along with Public Service Aspirants Nagaland (PSAN) has filed a public interest litigation (PIL) against what it has alleged as 705 backdoor appointments made by 35 different departments of the government of Nagaland.A press release from the ACAUT on Saturday informed that the litigation has been filed at the Gauhati High Court, Kohima Bench.
The litigation contains three issues: “To quash and set aside the appointment of 51 backdoor appointees appointed against NPSC posts; and since the appointments were made after the HC Kohima Bench, had banned backdoor appointments (on) 6th June 2016 judgment, to treat such appointments as contempt of court.“Quashing of the Office Memorandums (sic) of 4/8/2008 and 11/8/2016 which confers powers upon the government to regularize all backdoor appointments after 3 years of service which is in total contravention of the SC judgment as passed in Uma Devi case, 2006, which says that backdoor door appointment is illegal and ultra vires of the Constitution. “(And) To terminate the services of all 655 backdoor appointments made against NPSC posts, that is, appointed between the Uma Devi judgment of 2006 and Gauhati HC order, Kohima, dated 6/6/16”.It demanded that the state government must requisition all the 705 (655+51) posts to the NPSC for general recruitment through open competitive examination, and also ‘submit the detailed status report of the 705 backdoor appointees before the court’. It listed some of the ‘prominent departments’ where said backdoor appointments were made as:
• Social Welfare- 77 posts
• RD-57 posts
• SCERT- 74 posts
• DG of Police- 14 posts
• Tourism – 10 posts
• Geology and Mining- 10 posts
• PWD- 81 posts• Medical- 138 posts
• Higher and Technical Education- 59 posts
• Eco and Statistics- 24 posts
• Art and Culture- 6 posts
• Treasuries and Accounts list (8 departments) - 36
• AG list (16 departments) - 70
It reminded that the court has ‘stayed and suspended the most contentious’ office memoranda of 4/8/2008 and 11/8/2016 ‘till the PIL is disposed off’. “Also, the 51 backdoor appointees have been directed to appear before the court as respondents which have been published in the papers as well with names. Therefore, any department trying to appoint or in the process of regularizing posts will be held contempt of court” the statement read.
