The AICC members from Nagaland said that the show cause notice issued by Chairman, Disciplinary Action Committee, NPCC was untenable and devoid of jurisdiction authority.
In a reply to show cause notice served on October 19, four AICC members including K.V. Pusa, Joshua Sumi, Tarie Zeliang and Asu Keyho pointed out that the show cause notice with reference to INC Article XIX (f) (iv) without reference of any clause was vague and devoid of sanctity.“Whereas, Article XIX (f) (IV) (b) states that “The Executive of a PCC can take action only against committee subordinate to it and individuals other than members of the AICC and members of Parliament in whose case it can only make recommendations to the working committee for Disciplinary Action.”
The members added, on proper scrutiny of your show cause notice and the enclosures attached, there is no indication to suggest any direction or notice from AICC office to initiate show cause notice to all of them.
“As a matter of fact your show cause notice is found to be untenable and devoid of jurisdiction of authority. It may also be noted that this intimation of show cause notice reply have the verbal endorsement of officials in the AlCC office at New Delhi.”
