Dimapur, Nov. 17 (EMN): Session judge cum special judge POCSO Act, Phek, N Longshithung Ezung, has sentenced Surhoseyi Keyho to undergo 10 years rigorous imprisonment with a fine of Rs 10,000 for committing rape on the minor continuously on several occasions.
The sessions Judge-cum- Special Judge POCSO, Phek, convicted the accused Surhoseyi Keyho in GR No- 48/16 u/s – 376/376 (h) IPC R/W Sec-6 of POCSO Act by a judgement dated 10-11-17. The case was represented for the State by Samuel Ritse, APP cum government pleader, Phek, and the accused was defended by retainer council (PDLSA) Mamang Singson.
In a complaint lodged by the guardian of the victim on September 3, 2016, he had implicated the accused Surhoseyi Keyho, resident of Bethany-I Colony of Phek town and an immediate neighbour, of committing rape on the maid servant who was about 14 years at the relevant time. The accused was also found to have committed rape on the minor continuously on several occasions.
The District and session judge cum special judge, POCSO, Phek, after framing the charge under the afore mention sections of IPC against the accused thereafter proceeded the case by examining the prosecution witnesses and examined as many as nine witnesses including Investigation Officer of the case. The court also considered the confession statement made by the accused U/S- 164 CrPC while convicting the accused.
The trial court found that the prosecution could able to prove the offence U/S-164 IPC r/w Section 5 POCSO Act beyond reasonable doubt against the accused Surhoseyi Keyho.
Accordingly, the court convicted the accused for committing rape and sentenced to undergo rigorous imprisonment for a period of 10 years and also pay a fine of Rs 10,000, which is punishable U/S 376 IPC and also for committing aggravated penetration sexual assault which is punishable U/S-6 of the POCSP Act.
