Dimapur, August 31 (EMN): The Public Interest Litigation filed by the Nagaland Tribes Council against the appointment of Advisers and Parliamentary Secretaries in the state government was admitted today by the Kohima bench of the Gauhati High Court.
The matter have been differed to September 11 for hearing .
A press release from NTC also stated that “The PIL was heard today on 31.08.17 and the Hon’ble High Court has posted the matter to 11.09.17 for further order and hearing.”
The NTC reminded about the 91st Amendment to the Constitution of India, and accordingly there should be only 12 Ministers in Nagaland State, including the Chief Minister.
However, it stated, “in Nagaland by notification dated 26.07.17 the Chief Minister of Nagaland has unconstitutionally appointed 9 Advisors and 26 parliamentary Secretaries under Rule 5 of the Rule of Excutive Business for the Government of Nagaland”.
Citing the cases of Sikkim and Mizoram where there are no longer posts of parliamentary secretaries, the NTC hoped that parliamentary democracy will be restored and “illegal offices” will be removed to relief the people of from the ” extraneous action” of the state.
