Para legal volunteers urged to be decorous

Dimapur, April 9 (EMN): Tuensang District Legal Services Authority under the aegis of Nagaland State Legal Services Authority, conducted one-day training-cum-orientation programme for Panel Lawyers and Para Legal Volunteers at NAVINN Conference Hall on April 1.
Session Judge & Chairman of Tuensang DLSA, Mayang, while speaking on dos & don’ts, said as a citizen of a Democratic country, we stands on three pillar i.e. legislation, executive and judiciary. He pointed out that unless we set up works properly it gives rooms for corruption resulting in non-availability and improper implementation of laws and welfare schemes, poor governance, bad road, etc. Therefore to strengthen the judiciary towards achieving, he said we need to stand up and help the common man in securing access to justice.
He said Legal Services Authority selects Para Legal Volunteers and trained them so that they can assist and guide the common man. PLVs are the one person who acts as mediator between the common man and legal institution and therefore it is the duty of the PLVs to sit in the 24 Legal Aid Clinic setup within Tuensang District to rendered services to the legal aid seeker, Mayang added.
He also urged the PLVs to live a life of dignity so that the needy can approached them with confident in order to confide their problem.
Resource person, Yimtsusangla Chang, Retainer Lawyer of Tuensang DLSA initiated Practical session.
Practical on writing petition, complain and FIR was presented by Tongpang L. Jamir, Master Trainer (PL) of NSLSA. He also shared on consumer redressal techniques & forum.
Trainees were also apprised on their role in crimes against women, human trafficking and role play by PLVs, important terms on Juvenile Justice Act, welfare schemes, motor vehicle accident claims/cases, prisoner Rights and legal services, maintenance of record, PLV register and filing of success stories.
During the discussion session, it was also clarified that victim compensation can be claimed even after a lapse of few years from the concern authority and in case of individual or freak accident; claim can be applied to Disaster Management.
Mayang Lima, Sessions Judge and chairman of Tuensang DLSA apprised the participants on some vital facts while giving assistance to the aggrieved women in case of domestic violence case. He said in case of accident, gratuitous passenger travelling in goods vehicle cannot claim compensation unless he or she is the owner of the goods or a labour for loading and unloading the goods and in case of accident when a victim is not a government employee, it should be mandatory to obtained income certificate from the Village Council or area chairman or executed affidavit to that effect to prove income seeking compensation. Mayang further pointed out that a passenger while travelling should always insist on ticket that would amount to subsisting agreement till reaching destination. In case of accident, passenger list, ticket list, police report, medical report, medical certificate are required to be submitted to claim compensation. If the claimant does not have money to hire lawyer they can approach front office for availing Legal Aid Counsel at free of cost.
It was also clarified during the discussion that ex-gratia is a welfare scheme by the Government and not a compensation Scheme and therefore MACT claim can be filed before the forum.
