JMFC rejects discharge petition

DIMAPUR, OCTOBER 25 : On the same day that she deferred the hearing on the alleged fake academic affidavit of Lok Sabha member, Neiphiu Rio, the Judicial Magistrate First Class, Kohima, Tucuno Vammo also rejected the discharge petition filed by the then vice principal of Kohima College. The ruling was made available through an email late Monday night, which inadvertently resulted in the communiqué missing our deadline. After considering the arguments by both the counsels, the JMFC Kohima ruled that “it may not be appropriate to discharge the present accused therefore, the discharge petition is hereby rejected.”
It might be noted that the same judge had deferred the hearing on Rio’s case to November 11 next following an appeal for more time by the complainant. Rio also had come to appear before the court that day, stating that he was there to prove his innocence. As reported that day in Eastern Mirror, the complainant, Dr Rosemary Dzuvichu has filed a case at the Gauhati High Court Kohima Bench challenging the District & Session Judge, Kohima ruling to transfer the case from the court of the Chief Judicial Magistrate Kohima to Judicial Magistrate First Class, Kohima.
